Lawyers for former President Donald Trump had less than a day to review Monday's Supreme Court decision on presidential immunity.
Trump's legal team sent the letter to the judge presiding over the New York hush-money trial in which the former president was convicted of 34 felony counts, according to The New York Times, which obtained the letter and later confirmed the Times report to The Associated Press.
The defense cited a Supreme Court ruling Monday morning that gave presidents little immunity from prosecution for their work while in office and asked the justices whether they could petition to have the former president's criminal convictions thrown out.
Trump's lawyers did not immediately respond to Business Insider's request for comment.
A spokesman for Manhattan District Attorney Alvin Bragg, who presided over the hush money trial, declined to comment.
The letter sent by Trump's lawyers was not scheduled to be made public until Tuesday, according to the Times.
A verdict in President Trump's hush money trial is scheduled for July 11.
It's unclear how successful Trump's efforts to overturn his conviction will be: The deadline for post-trial motions passed in June, The Times reported.
Neama Rahamani, a former federal prosecutor and president of West Coast Trial Lawyers, told Business Insider that Trump's attempt to overturn his conviction is “unlikely.”
The Manhattan trial has primarily concerned actions taken by Trump before he became president and centred on hush money paid to porn star Stormy Daniels before the 2016 election.
“These payments were made from Mr. Trump's personal accounts, the individuals involved were employees of the Trump Organization and Michael Cohen was Mr. Trump's personal lawyer,” Rahmani said.
Rahmani He predicted that Judge Juan Marchand, who is presiding over the hush-money lawsuit, will deny Trump's motion to overturn his conviction. Trump's lawyers will likely seek a stay of the sentence while the motion is heard on appeal. Marchand could choose to put the entire case on hold while the motion is heard, or he could choose to enter judgment, Rahmani said.
“Trump's approach has always been to delay, even if there are no substantively good arguments,” Rahmani said.
