April 29 – The United States Supreme Court on Thursday heard arguments regarding presidential immunity related to interference in the 2020 election and the events of January 6th.
If the president is granted immunity, the effects could last for years to come.
“This is a really big case, not just because of the current situation with Trump, but as all the justices commented yesterday, no matter what they decide, this is a landmark case,” attorney Clint Barkdoll said. “They are well aware of the fact that this is going to be a major event.” The case is forever. This is one of those things that you're going to see cited over the decades, or even centuries, as these things can develop. ”
Supreme Court experts suggest the court is likely to compromise on the situation.
“They're not going to judge President Trump to be absolutely immune, but at the same time they're not going to say he's not immune,” Barkdoll predicted. They will likely say that their immunity is limited and that they intend to distinguish between what is official and what is private action. That's the big question in the Trump case. They would say that if it was a public act, there would be immunity. There is no immunity if it is a private act or a public act without a legitimate purpose. ”
Among the questions yesterday was what would happen if the president sent in the military to stage a coup. What would happen if the president sent Team 6 of the SEALs to kill the enemy?
Barkdoll said: The president is not above the law. On the one hand, it suggests that courts should grant immunity even if the president acts in good faith as an official act, even if it has bizarre and bizarre consequences. They don't want to hold the president in such a way that he fears he will be exposed to criminal prosecution or civil liability every time he does something. So it looks like he's going to land there. ”
We probably won't have an answer until sometime in June.
“The other important thing here is that this is a late victory for Trump,” Barkdoll said. So Trump's goal is to delay all of these cases. This decision has a lot to do with one of his pending criminal cases. If the court does not rule by the end of June, there is no way the case will go to trial before the November elections. ”
NewsTalk 103.7FM's Michele Jansen said: “Unfortunately, I think they were successful in their zeal to go after this guy. For some of the people involved in all of this, it's mostly for personal reasons. A lot of what feels like that is what they've done.” It just blatantly clarifies the argument that this is impossible. They keep saying, they keep putting out polls, if he's convicted, people say he won't be voted out. Could it be any more obvious than this, such as abusing the legal system to go after political opponents and former presidents? So, actually, they're advocating a lot for him. People cannot be afraid to run for office because it will destroy their lives and devastate their finances. I'm just trying to protect it from something. Extended legal discussions are currently underway to try to overcome them. ”
Barkdoll added, “I think that's certainly part of the consideration for the Supreme Court justices to take into account here. If you think about it during yesterday's argument, another day in a courtroom in New York City. President Trump is juxtaposed with this very vile and vile account by David Pecker of the National Enquirer about all of this that he and Mr. Trump were doing before and after. Although many of them are not very appealing, many legal experts continue to point out that none of them are necessarily illegal, especially in the New York case. Do you ever wonder if there was, wasn't there some effort just to embarrass him? I mean, the testimony that comes out day in and day out from the National Enquirer has everyone thinking. I think it's worse than it used to be, but it's still not illegal per se. So what on earth is it presenting? I've been thinking about it for years. But why would someone want to run for these positions? Some of the more talented people in this country aren't interested in all these things we're talking about. This is a problem.”
