Officials said Smerko was found to be in possession of digitally altered photos of child actors appearing nude or engaging in sexual acts. The photos were discovered when law enforcement searched his computer at his Pittsburgh home.
While awaiting trial, Smelko was found to have violated the terms of his release by again possessing photographs of the same nature. The photo was discovered after a concerning search and the image was detected by court-ordered cell phone monitoring software.
In November 2023, a federal jury in Pittsburgh convicted Smelko of one count of possession of child pornography and one count of accessing child pornography for the purpose of viewing.
